Officials Say Texting Ban In Indiana Isn’t Working

May 2, 2012

Despite Indiana’s governor signing a law in July that made it illegal to text while driving, experts say the problem hasn’t stopped. According to WTHITV 10 News, Indiana police are blaming the problem on the actual wording of the law and the difficulties of enforcing it.

The law states that the use of any handheld device to read or transmit a text message or email while driving is illegal. It further states that drivers younger than 18-years-old are not allowed to use any electronic device at all while driving, except for in emergency situations.

Since the laws inception, very few tickets have been issued for infractions. In Vigo County, only three tickets have been written in the 10 months the law has been on the books. It’s not that people aren’t committing violations, as a recent study found that 57 percent of Indiana teens text while driving. So what seems to be the problem?

Police say the wording of the law makes it extremely difficult to enforce, as officers must actually catch violators in the act, which can be hard to decipher at times and even more difficult to prove.

If you’ve been injured in an Indiana Car Accident that was caused by someone using a cellphone, the Indiana Injury Lawyers with Fleschner Stark Tanoos & Newlin say that may be considered negligence on the driver’s part, and you may be able to hold them responsible for damages.

Lack Of Seat Belts Blamed On High Number Of Fatal Car Crashes

April 4, 2012

Statistics show that not wearing a seatbelt is one of the most dangerous things you can do when in a moving vehicle. The National Highway Traffic and Safety Administration shows that only 49 percent of speeding drivers under the age of 21 years old who were involved in fatal crashes were wearing seat belts.

Drivers also are 10 times as likely to be killed in an accident if they’re not properly restrained. These numbers show why seat belt use is so vital for staying safe on the roadways.

Recently, a Greene County, Indiana, a man was killed when he was involved in a single-vehicle accident because he wasn’t wearing his seat belt. According to reports from WTHITV 10 News, the crash happened Friday on State Rd. 54, just east of the Greene Co. 4-H Fairgrounds.

Reports from the Indiana State Police who investigated the accident say that the driver from Elnora, Indiana, was heading east along the road when he lost control of his vehicle, veered off the highway and struck a guardrail. Because he was not restrained, the impact ejected the man from the vehicle. He was taken to the Greene County Hospital where he died from his injuries.

The Indiana Auto Accident Lawyers with Fleschner, Stark, Tanoos & Newlin ask that you stay safe while driving by always putting on your seat belt before setting off for your destination.

Weather A Factor In Two-Vehicle Collision That Injures Five

March 28, 2012

Five people were taken to the hospital as the result of a crash that occurred Friday in rural Illinois. According to The Tribune-Star, the accident happened around 4:00 p.m. at the intersection of US 36 and Douglas County Road 2200 East.

The Illinois State Police Department indicated that the 38-year old driver of a pickup truck hauling a trailer lost control of his vehicle due to weather conditions and began to spin out of control as he headed west along the highway. The truck and trailer jackknifed as they crossed over the center dividing lines of the highway and into the path of an oncoming vehicle.

That vehicle hit the rear of the truck, which stopped the spin but caused the trailer to tip and smash onto the roof of the car.

The 30-year old driver of the car and her passengers, ages 4 to 60, were taken to Carle Foundation Hospital in Urbana, Illinois, by ambulance and were treated for injuries ranging from minor to moderate.

Investigators stated that citations were not given to either driver in connection with the crash.

The Indiana Auto Accident Lawyers with Fleschner, Stark, Tanoos & Newlin say that in bad weather conditions, drivers should slow down and allow other drivers in front of them more space than usual. This will increase the amount of time you will have to react if an accident occurs in front of you.

Terre Haute Rollover Crash On I-70 Injures One

March 21, 2012

A single-vehicle rollover accident Tuesday on I-70 near Terre Haute, Indiana, was the cause of a chaotic scene on the side of the highway. According to Channel 10 News, the crash happened at 11:04 a.m. near mile marker 10.5.

Reports from troopers with the Indiana State Police indicate that a 20-year-old driver of a 1998 Ford Explorer SUV was heading east on the road when he was cut off by another vehicle making a sudden lane change. The tight lane change forced the young man to slam on his brakes and jerk the wheel of the vehicle toward the shoulder of the road to avoid a collision. This led to the SUV going off the side of the road and rolling over once.

Troopers were able to stop the other vehicle approximately 10 miles up the road, but upon further investigation decided not to ticket either driver.

The young man who was behind the wheel of the SUV refused medical attention at the scene for several lacerations he suffered and was subsequently released.

Investigators say that all parties involved were wearing seat belts and that drugs and alcohol are not considered factors in the crash.

The Indiana Auto Accident Lawyers with Fleschner, Stark, Tanoos & Newlin say that while no one was seriously hurt in this crash, it does serve as a reminder to check your mirrors twice before changing lanes and to always buckle up for safety.

Alcohol And Drugs Blamed For Terre Haute Single-Car Crash

March 14, 2012

Alcohol and drugs are to blame for a single-vehicle Vigo County crash that injured the 24-year-old driver. According to The Tribune-Star, the accident occurred Tuesday morning at South Morris Place near Florine Drive.

Lt. Don Westerfield, a spokesman for the Vigo County Sheriff’s Department, stated that the young man was driving at a high rate of speed when one of the tires on his vehicle became flat. He then lost control  and veered off the road, striking a mailbox and a tree.

The driver suffered a serious back injury in the crash and was taken to Terre Haute Regional Hospital before being transferred to an Indianapolis hospital. Blood analysis after the accident showed that the driver had a blood alcohol content of .164 percent, more than double the legal limit. He also tested positive for marijuana.

According to reports from WTHITV 10 News, the accident happened last Wednesday at 9:46 a.m. at the intersection of South 13th and Crawford Streets in Terre Haute, Indiana.

Two Injured In Indiana Crash After Driver Falls Asleep At The Wheel

February 29, 2012

Fatigued driving may be the cause of a Taylorsville, Indiana, car accident that left two men injured yesterday. According to reports from The Republic, the crash happened just after 3:15 PM, in the southbound lanes of I-65 near the Taylorsville exit.

The Chief Deputy of the Bartholomew County Sheriffs Department, Maj. Todd Noblitt, stated that a 68-year-old man was driving a van down the highway with a 61-year-old passenger when he began to drift to sleep. As he slipped deeper into sleep, the van began to veer off to the shoulder of the highway where it plowed through approximately 30-feet of guardrail before flipping.

The two men were able to get free from the wreckage and were taken to Columbus Regional Hospital. The driver was treated for hip pain, while the passenger received care for minor injuries to his arms.

Fatigued driving can be as dangerous as drinking a driving. Statistics from the Department of Transportation show that driver fatigue is a factor in 19 percent of accidents and the cause of nearly 5 percent of all fatal crashes. Fatigue:

  • Slows Reaction Time
  • Decreases Awareness
  • Impairs Judgment

If you’re driving, the Indiana Auto Accident Attorneys with Fleschner, Stark, Tanoos & Newlin suggest allowing yourself time to stop and rest if needed. Roll down the windows and talk until you find a safe place to stop. Also, remember to allow yourself time to become alert before driving after resting.

Six People Injured in Terre Haute, Indiana, Multi-Vehicle Crash

February 22, 2012

Six people were injured in a chain-reaction car accident Tuesday morning in Terre Haute, Indiana. Reports from the Tribune-Star indicate that the crash occurred around 9:45 AM at the intersection of 13th and Crawford Streets.

Assistant Terre Haute Police Department Chief Shawn Keen said the incident began when an officer noticed a pickup truck speeding and weaving in and out of traffic. When the officer flashed his lights in an attempt to pull the vehicle over, the driver accelerated and slammed into the rear end of a 1999 Ford Mustang. The impact caused the Mustang to then slam into the rear end of other vehicles stopped in traffic.

The driver of the Mustang was pinned in the wreckage that had caught fire, but was pulled to safety after employees of nearby businesses rushed to the scene with fire extinguishers to put out the blaze. One worker smashed in the driver side window of the Mustang to pull the victim free. Police say the quick action probably saved the woman’s life.

All of the injured victims were taken to local hospitals to receive treatment for non-life threatening injuries.

Indiana Tractor-Trailer Crash Leaves One Dead and Two Others Injured

February 15, 2012

A tractor-trailer driver was killed and two others injured in a collision Tuesday morning along Interstate 70 in Hendricks County, Indiana. According to reports from the Tribune-Star, the crash happened around 7:30 AM, near mile marker 57, just outside Monrovia, Indiana.

Reports from the incident filed by troopers with the Indiana State Police who responded to the scene indicate that a 64-year-old truck driver from Indiana was broken down on the side of the interstate and hooking up to a tow truck driven by a 30-year-old man. The two men were standing between the tow truck and the big rig when a second tractor-trailer, driving much faster than other vehicles according to witnesses, jackknifed and slammed into the trailer of the disabled semi. The impact caused the truck to lurch forward and pinned the big rig’s driver between the two vehicles.

The man who was pinned was declared dead at the scene, while the tow truck driver suffered critical injuries to his lower body and remains hospitalized at Wishard Hospital in Indianapolis. The driver of the second tractor-trailer was also injured.

The trucking industry is regulated by stringent rules that are designed to protect drivers and other motorists from harm while sharing the road with these massive commercial vehicles.

The Indiana Truck Accident Lawyers with Fleschner, Stark, Tanoos & Newlin send our condolences to the families of those who were injured or lost their lives in Tuesday’s collision.

Drunk Driver Responsible For Parke County Crash

January 25, 2012

Four people were hurt last Saturday night in a multi-vehicle crash caused by a drunk driver. According to My Wabash Valley, the 33-year-old woman responsible for causing the accident had a blood alcohol level of .025 percent at the time of the crash–more than three times the legal limit.

Reports by the Parke County Sheriff’s Department say that the accident happened at about 6:30 in the evening on US 36, near the bridge crossing Raccoon Lake. It was there that the drunken driver rear-ended a vehicle driven by a Rockville, Indiana, woman. The collision caused the victim’s car to spin into the oncoming lanes of traffic, where a third vehicle then hit it.

The Rockville woman was rushed to Methodist Hospital in Indianapolis where she is still listed in critical condition, while three others suffered minor injuries. The drunk driver was not injured and was placed under arrest on suspicion of DUI.

The Indiana Criminal Justice Institute states that one third of all drivers  involved in a fatal crash in Indiana during 2005 had some measurable level of alcohol in their system.

This is why the Indiana DUI Accident Attorneys with Fleschner, Stark, Tanoos & Newlin ask drivers to do their part in keeping Indiana’s roadways safe by not drinking and driving. Instead, call a taxi or a friend to get you home safely. If you have been injured in a drunk driving accident at no fault of your own, contact an experienced attorney today.
