Indiana Family Settles Medical Malpractice Suit Out of Court

A family can rest a little easier now that their Indiana medical malpractice suit against a Florida-based healthcare company came to an abrupt close less than two weeks ago, with an out-of-court settlement for an undisclosed amount.

The South Bend Tribune reports that the deal was struck hours before a fourth day of testimony in a trial before six jurors. The family was seeking a $10 million settlement against Interim Healthcare Inc., a home healthcare company,  for damages the family contends came after a nurse failed to follow proper procedure when a respiration tube became blocked by mucus in the throat of their 2-year-old, who was under the company’s care in 2007.

Rather than clearing the blockage and replacing the tube, the nurse called 911 and waited for more than 10 minutes for paramedics to arrive and care for the child. During this time, the child’s brain didn’t receive oxygen and he suffered severe and permanent brain damage.

According to representatives of the family, “They are glad it is over.”

One Killed in Indiana Truck Accident on I-465

The driver of a fuel tanker was killed after an accident occurring early Wednesday morning in Speedway, Indiana. Roads were closed for hours due to the fuel spill that resulted from the crash. According to WISHTV8.com, the accident occurred in just after 12:30 AM on Crawfordsville Road’s I-465 entrance ramp.

The crash occurred after the driver of the fuel tanker lost control and slammed the vehicle into a concrete road barrier. The impact of the crash flipped the truck and crushed the cab, killing the driver inside. Approximately 3,000 gallons of unleaded gasoline leaked from the truck’s 20,000 gallon tank into a nearby drainage ditch. Drivers were urged to avoid the area while experts worked to remove remaining fuel from the tanker and transport it to another area. Police expected the roadway to reopen by noon Wednesday.

A representative of the company the driver was working for was present at the scene of the accident, but declined to comment on the circumstances of the Indiana truck accident.

Man Arrested After Hitting and Killing 7-Year-Old Boy with Car

A Sumner, Illinois man was arrested Monday for driving under the influence, after killing a 7-year-old boy who was riding his bike. News Channel 10 reports that the driver was heading eastbound on South/East Street when the boy’s bike veered slightly into the lane and was struck by the vehicle. The driver, 31 years of age, was arrested by officers at the scene after failing field sobriety tests and was booked for driving under the influence. He is being held pending more serious charges.

The boy was transported to Lawrence County Memorial Hospital by ambulance, where he later died from the injuries sustained in the accident.

Mothers Against Drunk Driving (MADD) reported that the state of Illinois ranks 37th among the 50 states for the number of drunk driving incidents. Those incidents include 319 fatalities between 2007 and 2008. That means 35% of all traffic deaths during those years were directly related to driving under the influence, costing the state $1.66 billion dollars. It is surprising that more fatalities have not occurred, considering the state is home to nearly 50,000 3-time DUI offenders, and 5,659 5-time offenders.

Two Injured When Car Strikes Moped

An accident in which a car struck a moped occurred last Saturday night, sending two people to the hospital and another to jail. The Terre Haute Tribune Star reported the accident occurred around 10:30 PM on US 40. The driver of the Buick Skylark involved in the crash stated that a driver in front of him made a sudden lane change, causing him to swerve to avoid a collision with that vehicle, instead striking the rear of the moped. The collision caused both the driver and a passenger on the moped to be thrown from it. The moped driver was transported to Union Hospital and remains there in fair condition. The passenger was thrown into the windshield of the car and was transported to Methodist Hospital in Indianapolis, Indiana, by helicopter and remains there in critical condition.

The driver of the car was not injured, but was arrested on suspicion of operating a motor vehicle under the influence of a controlled substance, possession of drug paraphernalia and driving with a suspended license. The National Highway Traffic Safety Administration (NHTSA) reported that Indiana has a no tolerance policy for schedule I and II drugs under Indiana Drug Per Se Laws.

Swim Lessons Make Lebanon Boy a Lifesaver for Baby Sister

An 8-year-old boy hopes to spread the message that swim lessons save lives after jumping in the family pool to rescue his baby sister earlier this month in Lebanon, Indiana. According to WISHTV 8 News, the boy found his 2-year-old sister gasping for breath in the family pool and jumped in to save her. The boy and his family credit his swimming abilities, which have developed throughout years of lessons, for rescuing his sister from drowning. The young hero was honored by the local fire department, who presented him with a certificate of recognition for his achievement in water rescue.

Indiana Man Crashes Car While Texting and Driving

A new Indiana law banning texting while driving went into effect last Friday, and the Indy Star reports that authorities ticketed one of the first offenders after he drove through building in Richmond, Indiana.

The accident occurred around 12:30 PM Tuesday, as the 21-year-old driver headed south on Chester Boulevard. The young man told police he was texting and driving when his Chevrolet sedan crossed the center line into oncoming traffic and jumped a curb. The car went through the front wall of a medical equipment company, traveling about 50 feet through the building before smashing through the other side. A witness told police that the vehicle was going “pretty fast,” and she initially thought the driver was having a seizure. Luckily, no one was injured in the accident. The driver was ticketed for operation of a handheld communication device while operating a mobile vehicle, making him one of the first individuals to be cited under the new ban.

Semi Truck Driver Sentenced For Man’s Death

A semi truck driver in Terre Haute, Indiana, was sentenced Monday in court for causing the death of a 25-year-old man last November. In statements before and during the hearing, the truck driver admitted to being under the influence of cocaine while he was driving and fell asleep at the wheel. Shortly thereafter, the eighteen-wheeler plowed through the young man’s car, which was stopped in traffic.

According to News Channel 10, the truck driver had a history of driving under the influence and was not supposed to be on the road at the time of the accident because of a suspended license. He plead guilty to causing death while operating a vehicle under the influence. The judge sentenced him to 12 years in prison as part of a plea agreement, along with mandatory completion of drug and alcohol counseling while in prison. With good behavior, he will likely serve half the time of the sentence.

The victim’s family feels as though the courts did not serve justice. The victim’s wife said, “I don’t think any (amount of) time is enough.” His mother stated, “In six years he’ll be out, he’ll get on with his life. I’m still not going to have my son back.”

Texting And Driving Banned In Indiana After July 1

After June 30th, you had better think again about sending someone a text message if you are behind the wheel of a vehicle. According to The Tribune Star, Indiana’s distracted driving law is undergoing some major overhauls that take effect July 1.

It will now be illegal to type, send, or read a text message or e-mail while operating a motor vehicle, punishable by a fine of up to $500. Current distracted driving laws prohibit drivers less than 18 years of age from operating any wireless device while behind the wheel.

Officers are finding that it will be a difficult law to enforce due to the many uses of cell phones today as calendars, music players, and other various functions. It is up to an individual officer’s discretion whether an infraction has occurred. Law prohibits authorities from confiscating a phone to see recent activity.

The wording of the law has many worried that it may not be effective, as it still allows talking on the phone and using the phone for numerous other applications such as video games or browsing the internet.

Medics Uncover Growing Problem WIth Private Ambulances

The voices of medics across the state of Indiana are being heard as they shed light on a secret practice. Nursing homes are calling private ambulance companies, sometimes miles away, instead of dialing 911 in life threatening situations.

13 Investigates uncovered the story of an Indianapolis woman who died after going into cardiac arrest and waiting close to a half hour before a an ambulance arrived.

The report stated that the woman went into cardiac arrest around 8:15 PM on March 5. The nursing home the woman was living in called their private ambulance company, but was told it would be 20-30 minutes before they would arrive. Experts say the dispatcher should have realized this was too long to keep such a critical patient waiting and should have recommended the nursing home call 911 to alert an ambulance crew that was only five minutes away. Instead, he scrambled a crew from across town in order not to lose the run and the dollars associated with it.

“Unfortunately, private services, more at the management level, are so money driven, so hungry for being for-profit companies, that they will do everything in their power to not turn the run.” one medic explained.

Two Killed In Crash Involving Minivan and Semi Truck

A Coles County roadway was the scene of a grisly accident, between a semi truck and a minivan, which took the lives of two teens from Mattoon, Indiana. Terre Haute News Channel 10 reports that the accident happened on Indiana Route 316, just west of Coles County Road 1100E.

According to officials a minivan driven by a 26-year-old woman and carrying seven passengers was traveling eastbound on the roadway. The driver attempted to pass another vehicle and lost control of the vehicle. The van ended up in the westbound lanes where a passing semi truck was unable to avoid smashing into the vehicle, and hit the rear passenger side. The Van then rolled and came to a halt after sliding into a ditch.

Two teen passengers in the van were declared dead on the scene. All other passengers in the van, including four children under 8-years-old, were transported to a local hospital to be treated for injuries. There is no report on the condition of the truck driver, as the crash is still under investigation.
