Talc Ovarian Cancer Lawsuits Continue Moving Through the Court System

Talcum powder has been used for personal hygiene purposes for more than 50 years, but recent research suggests using products containing talcum powder increases the risk of developing ovarian cancer. In fact, a study published in the June 2013 issue of Cancer Prevention Research found that as many as 30 percent of women using hygiene products containing talcum powder were at an increased risk of developing the disease.

Manywomen have filed talc ovarian cancer lawsuits as a result of this risk, claiming companies failed to warn consumers. A majority of these cases are still working through the court system.

Reuters reports that roughly 200 talc ovarian cancer lawsuits will return to a Missouri courtroom after the defendant in the cases, Johnson & Johnson, moved to have the lawsuits consolidated into a federal court. Judges ruled the cases shouldn’t be considered “mass actions,” which would place the cases in federal jurisdiction, because attorneys had never proposed the cases be heard together. The ruling could have a significant impact on the outcome of each case.

Holding manufacturers of faulty products accountable for their actions is part of our mission at Fleschner, Stark, Tanoos & Newlin. Our legal staff is hopeful that rulings in the talc ovarian cancer defective product lawsuits will help bring closure to victims and their families.
