When a person is killed in a motor vehicle collision resulting from another motorist’s negligence, the family of the victim may seek compensation for their loss by filing civil litigation against the parties responsible for their loss. The Indiana Car Accident Lawyers with Fleschner, Stark, Tanoos & Newlin explain that such a case was recently filed in Henry County District Court.
According to an article published by The Star Press, the incident occurred at around 11:15 a.m. this past July 20 along U.S. Highway 35 outside of Blountsville, Indiana. Reports indicate the driver responsible for causing the crash was traveling north along the highway in a 2005 Chevrolet Equinox SUV when the vehicle suddenly began to hydroplane. The driver was unable to regain control of the machine before it collided with a 2004 Kia Spectra carrying five passengers, including three young children.
The crash claimed the lives of two passengers in the Kia and now, the family of one of the children who survived has filed a personal injury lawsuit against the man who caused the crash.
The lawsuit claims the responsible driver failed to take reasonable care in controlling his vehicle and its speed. Furthermore, it alleges he failed to obey traffic signals. The family is seeking an unspecified amount in damages.
The law firm’s team of Indiana Personal Injury Lawyers understands how difficult the loss of a loved one can be and are hopeful a decision in the case brings closure to the family of the victim.
